| NEW DELHI: Bharti Group chairman Sunil Mittal Monday moved the Supreme Court for quashing summons issued by the CBI Special Court that had asked Mittal, a long with Essar Group promoter Ravi Ruia and former managing director of Hutchison Max (now Vodafone) Asim Ghosh to appear before it on April 11. The special Delhi Court is examining alleged irregularities and losses in allocation of airwaves in 2002 when BJP-led National Democratic Alliance was in power. It had summoned the three top executives on March 19 when it took cognizance of the charge sheet filed by the Central Bureau of Investigation (CBI) against former telecoms secretary Shyamal Ghosh and three companies - Bharti Cellular (now Bharti Airtel), Hutchison Max and Sterling Cellular (both part of Vodafone India). Bharti had said at that time that it was 'saddened' at the summons being issued and that it will 'fight' the charge sheet which it termed as 'an an attempt to tarnish the company's reputation.' The Sunil Mittal promoted telco had added that the federal investigating agency had not found any evidence of conspiracy against any individual, and claimed that the government had on several occasions stated in Parliament that additional spectrum gr anted to all operators and related spectrum usage charges were as per policy. After summons was issued, Mittal wrote to his senior managers that the company not committed any mistake. "Let me assure you that we have done nothing wrong... Nonetheless, we have to deal with this difficult situation. Over the next few days, we will prepare our legal position and I believe we have a strong case." ET had reported this last month. The Central Bureau of Investigation (CBI) had not named any company executives nor levied any charges against them when it filed the charge sheet in December. However, the court said that the executives 'used to chair board meetings' and controlled their respective companies' affairs and added that there was 'enough material on the record to proceed against' them. Judge OP Saini had said that they were prima facie, in control of affairs of the respective companies and they represent the directing mind and will of each of the companies. "They were/are 'alter ego' of their respective companies. In this fact situation, the acts of the companies are to be attributed and imputed to them. Consequently, I find enough material on record to proceed against them also," he had said in his order.
